Acceptance of Terms

By accessing or using KlicForge ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you disagree with any part of these terms, you may not access the Service.

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the updated Terms on this page. Your continued use of the Service after the effective date of such changes constitutes acceptance of such changes.

Use License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include any right to reproduce, distribute, or commercially exploit the Service.

You agree not to use the Service for any illegal activities or to violate any applicable laws, regulations, or third-party rights.

Account Security

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Data and Content

You retain ownership of all data and content that you upload, submit, or transmit to the Service ("Your Data"). We do not claim any ownership rights in Your Data.

You grant us a limited license to use, store, and process Your Data only to provide the Service to you and as permitted by these Terms and our Privacy Policy. You are solely responsible for the accuracy, quality, and legality of Your Data.

Prohibited Uses

You may not use the Service to:

• Violate any applicable law or regulation
• Infringe any intellectual property or other proprietary rights
• Upload viruses, malware, or other harmful software
• Spam, defraud, or engage in phishing activities
• Mine cryptocurrency or engage in other compute-intensive activities without our permission
• Reverse engineer, decompile, or attempt to derive the source code of the Service
• Circumvent fair use limits, rate limits, or other resource controls
• Deliberately exhaust token budgets, overwhelm rate limits, or trigger provider rate-limiting
• Use KlicForge to power a competing AI service without authorization

Fair Use & Service Limits

KlicForge enforces fair use limits on all pricing plans to ensure reliable service for all users. These limits include daily token budgets and per-minute request rate limits defined in our Fair Use Policy.

Token Budgets: Your plan includes a daily token allowance. Tokens include input, output, tool execution, and vision processing. You are responsible for understanding and managing your token consumption within the limits defined in our Fair Use Policy.

Soft Throttling: When you exceed your daily token budget, we apply soft throttling (request queueing, 5–30 second latency) rather than hard denial. Throttling remains in effect until your token usage drops below your budget.

Overage Billing: Startup and Business plans may incur overage charges for token consumption exceeding the daily budget on multiple consecutive days. Overage rates are $0.01/1k tokens (Startup) and $0.005/1k tokens (Business). Sandbox tier does not incur overage charges; soft throttling applies only.

Rate Limits: Each plan has per-minute request rate limits. Exceeding rate limits triggers automatic request queueing and retry. Repeated rate limit violations may trigger investigation for abuse.

Upstream Provider Limits: KlicForge relies on third-party AI providers (OpenAI, Anthropic, Cloudflare, OpenRouter) that enforce their own rate limits. If we hit a provider limit, your requests are automatically queued. We are not liable for provider outages or rate limit exhaustion beyond our control.

Suspension for Abuse

We reserve the right to suspend or restrict your account if we detect abuse, including but not limited to:

• Deliberate circumvention of fair use limits or rate limits
• Resource exhaustion attacks or denial-of-service attempts
• Unauthorized reselling or service arbitrage
• Malicious use (spam, scraping, phishing, unauthorized data access)

For suspected abuse, we will typically issue a warning and request explanation before suspension. Suspended accounts may appeal via support@klicforge.ai. Immediate suspension without warning may apply if abuse is active and causing service degradation for other users.

Third-Party Services

The Service may include links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such services.

Limitation of Liability

To the maximum extent permitted by law, in no event shall we, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us during the 12 months preceding the event giving rise to the claim.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
